Welcome to Natality! By creating an account or using Natality, you’re agreeing to these Terms of Use (“Terms”). These Terms apply to your use of Natality and detail the Natality Service (the “Service”), described below, except where specific alternate terms are provided.

The Natality service

We’re committed to providing you the Natality Service, encompassing the Natality app and various features that align with our mission: To support your journaling practice and personal growth.

The Service includes:

Personalized journaling prompts, community engagement opportunities, and the ability to share and discover content and resources within a diverse user community.

Not a clinical or mental health service

Natality is designed to support reflective journaling, spiritual growth, and personal development. It is not a medical, psychological, psychiatric, or clinical mental health service, and it does not provide diagnosis, treatment, crisis intervention, or professional healthcare advice.

The Service, including any AI-generated prompts, reflections, insights, or community interactions, is not a substitute for professional mental health care, medical advice, therapy, counselling, or pastoral care. Natality is not intended for use in managing or treating mental health conditions.

If you are experiencing acute distress, thoughts of self-harm, suicidal ideation, or a mental health crisis, you should seek immediate help from a qualified professional or emergency service in your country of residence. Natality does not offer emergency support services.

By using the Service, you acknowledge and agree that any insights, prompts, or reflections provided are for informational, spiritual, and self-reflective purposes only, and that you are solely responsible for decisions made based on your use of the Service.

Promoting a positive community

Our tools and resources are designed to foster a supportive and encouraging environment. We actively combat abuse and policy violations, utilizing your data to maintain platform security. We use all of the information that we have – including your information – to try to keep our platform secure. More details are available in the Privacy Policy.

We use systems to understand your interests, helping you engage with content, events, and experiences meaningful to you.

Advancing with technology

Central to our Service is organizing and analyzing community data. We leverage AI and machine learning to personalize and safeguard our Service on a large scale, ensuring its functionality and integrity for a broad global community. These technologies enable us to apply complex processes across our Service.

Our global infrastructure necessitates storing and transferring data worldwide, including outside your country of residence. This is crucial for providing our Service, which includes integrating data to create as relevant an experience as possible.

These technologies do not provide medical or mental health advice and are intended solely to support reflection, learning, and personal insight.

Research and innovation

We use collected information to develop, test and improve our Service and collaborate with others on research to contribute to the wellbeing of our community whilst adhering to user privacy. This includes soliciting and analyzing data from our users to understanding how people use our Services, for example by conducting surveys and testing and troubleshooting new features.

Your data isn’t sold, and we don’t share information that directly identifies you without your expressed consent. Please refer to the Privacy Policy for more on data collection and use.

User eligibility

We want our Service to be as open and inclusive as possible, but we also want it to be safe, secure and in accordance with the law and traditional Christian values. So, we need you to commit to a few restrictions in order to be part of the Natality community.

To use Natality, you must:

  • Be at least 16 years old.
  • Not be restricted by law from accessing our Service or engaging in payment-related Services.
  • Not have had an account previously disabled for legal or policy violations.
  • Not be a convicted sex offender.

Usage and permissions

To engage with Natality’s online community, users are required to register for an account by providing up-to-date and accurate information, including their profile picture. To help support a transparent and accountable online space for all users, impersonation and use of avatars is prohibited, and you cannot create an account on someone else’s behalf.

Users are responsible for maintaining the confidentiality of their account and password.

Content, rights and restrictions

Your content is yours, but using our Service requires granting us certain legal permissions (“licence”) to operate. This licence includes hosting, using, and sharing your content. We do not claim ownership of your content that you post on or through the Service, and you are free to share your content with anyone else, wherever you choose. However, when you share, post or upload content that is covered by intellectual property rights (such as photos or videos) on or in connection with our Service, you hereby grant to us a non-exclusive, royalty-free, transferable, sublicensable, worldwide licence to host, use, distribute, modify, run, copy, publicly perform or display, translate and create derivative works of your content. This licence will end when your content is deleted from our systems. You can delete content individually or all at once by deleting your account.

As such, you give us permission to show your username, profile picture and information about your actions (such as journaling streaks, attendance to Natality events) or relationships (such as connections) next to or in connection with accounts, offers and other content that you engage with within the Service, without any compensation to you. For example, we may show that you liked an event created by Natality.

You are prohibited from engaging in any illegal, deceptive, or fraudulent activities, or any actions for unauthorized purposes. You must not breach, assist, or encourage others to breach these Terms or our policies, especially the Natality Community Guidelines. Posting branded content requires adherence to our policies, which forbid commercial content.

Actions that disrupt or hinder the Service’s intended function are not allowed. This includes improper use of our reporting, dispute, or appeals channels, such as making baseless or fraudulent reports or appeals.

Creating accounts, accessing, or gathering information in unauthorized ways is forbidden. This includes automated account creation or information collection without our explicit consent.

The sale, licensing, or purchase of any accounts or data from our Service is not permitted. This rule covers attempts to buy, sell, or transfer any part of your account (including your username), soliciting or using other users’ login details, or collecting Natality usernames, passwords, or misappropriating user data.

Posting private or confidential information of others without consent or infringing upon others’ rights, including intellectual property rights (such as copyright infringement, trademark infringement, or distributing counterfeit or pirated goods), is prohibited. You may use others’ copyrighted works within legal exceptions or limitations. You are responsible for ensuring you have all necessary rights to the content you post or share.

You are not allowed to modify, translate, create derivative works from, or reverse-engineer our products or their components.

Using a domain name or URL in your username requires our prior written approval. We reserve the right to change your username if necessary, for instance, to avoid intellectual property infringement or impersonation.

We retain all rights to our content covered by intellectual property rights and provided in our Service, such as images, designs, videos, or sounds that you might add to your content.

You are permitted to use our intellectual property, content, and trademarks only as explicitly allowed by our Guidelines or with our prior written permission.

To modify, create derivative works of, decompile, or extract source code from our products, you must either obtain our written permission or use an open-source license.

You agree that we can download and install updates to the Service on your device.

  • Not have had an account previously disabled for legal or policy violations.
  • Not be a convicted sex offender.

Account modification and termination

Additionally, we may end or modify the Service, remove or block shared content or information, or discontinue all or part of the Service if we deem it essential to prevent or mitigate negative legal or regulatory consequences for us. In instances where we remove content, we may inform you and outline any options for a secondary review, unless your actions gravely or repeatedly violate these Terms, pose legal risks, damage our user community, compromise our services, systems, or products, are limited by technical constraints, or are legally prohibited.

Upon your request to delete content or your account, the deletion process will begin within 30 days. The process of content deletion can take up to 90 days, during which the content won’t be visible to other users but remains subject to these Terms and our Privacy Policy. Post-deletion, it could take an additional 90 days to remove the content from our backup and disaster recovery systems.

Content won’t be deleted within 90 days in these situations:

  • If your content is being used by others as permitted by this licence and hasn’t been deleted (the licence will persist until such content is deleted).
  • If technical constraints prevent deletion within 90 days, we will complete the deletion as soon as possible.
  • If deleting content impedes our ability to investigate or identify illegal activities or violations of our terms and policies, protect the safety and security of our products, systems, and users, fulfill legal obligations like evidence preservation, or comply with legal authority requests. In such cases, the content will be kept only as long as necessary for these purposes, and the duration will vary case by case.

If your account is deleted or disabled by us, the contractual agreement under these Terms ends, but this section and the “Our agreement and what happens if we disagree” section will continue to apply even after your account is terminated, disabled, or deleted.

Our agreement and what happens if we disagree

Our Agreement:
Your use of music within the Service adheres to our Guidelines, and any use of our API is governed by our Terms and Policies. When using specific features or related services, you may be asked to accept additional terms, which then become part of our agreement. Should there be any conflict between these additional terms and this agreement, the additional terms will take precedence.

Should any part of this agreement be deemed unenforceable, the remaining provisions will continue to be in effect. Modifications or waivers to this agreement are only valid if they are in writing and signed by us. Our failure to enforce any provision of this agreement does not constitute a waiver of that provision.

We retain all rights that are not explicitly granted to you under this agreement.

Who has rights under this agreement

This agreement does not confer any rights upon third parties. You are not permitted to transfer your rights or responsibilities under this agreement without obtaining our approval. However, we may transfer our rights and obligations to another party, which could happen in the event of a change in our ownership, such as through a merger, acquisition, or sale of assets, or as required by law.

Who is responsible if something happens

We commit to delivering our Service with due care and skill, ensuring a safe, secure, and generally error-free environment. However, we cannot assure uninterrupted or flawless operation of our Service at all times. Assuming we have exercised reasonable care and skill, we are not liable for: losses not resulting from our breach of these Terms or from our actions; losses that were not foreseeable by both you and us when these Terms were agreed upon; offensive, inappropriate, obscene, unlawful, or other objectionable content uploaded by other users that you might encounter in our Service; reliance on the Service as a substitute for medical, psychological, psychiatric, or other professional care; and circumstances beyond our reasonable control.

This statement does not waive our responsibility for death, personal injury, or fraudulent misrepresentation resulting from our negligence. Additionally, it does not limit our liability in any areas where it would be illegal for us to do so.

How will we handle disputes

In the event of a claim or dispute related to your use of the Service as a consumer, both parties agree to resolve any personal claims or disputes in a competent court located in your country of residence, which will have jurisdiction over the matter. The laws of your country of residence will be applicable, irrespective of conflict of law principles. Conversely, if a claim or dispute arises from using the Service in a non-consumer capacity, such as for business or commercial purposes, it must be resolved solely in the HM Commercial Court in the UK. You consent to the jurisdiction of these courts for litigating such claims, and the laws of the United Kingdom will govern these Terms and any related disputes, again without regard to conflict of law principles.

Furthermore, you acknowledge that Natality has the right to initiate any claim, cause of action, or dispute against you in any competent UK court, at its discretion, if the claim is within the court’s jurisdiction.

Unsolicited material

We value your feedback and suggestions greatly. However, please be aware that we may utilize them without any constraints and are not required to provide compensation or maintain their confidentiality.

Updating these terms

We reserve the right to modify our Service and policies, which may necessitate updates to these Terms to ensure they accurately represent our Service and policies. Except when mandated by law, we will provide you with at least 30 days’ notice of any changes to these Terms, typically via our Service, allowing you time to review them before they become effective. By continuing to use the Service after these changes, you agree to be bound by the revised Terms. If you are unwilling to accept these or any updated Terms, you have the option to terminate your account through your profile settings.
